1. Information We Collect

We may collect:

• Photos and images you select or capture, and the text prompts you write, for editing
• Device information
• App usage and analytics data
• Subscription and purchase information
• Crash reports and diagnostic information

The photos you provide may contain a person's face, but they are treated solely as ordinary image files. We do not collect, extract, or generate any biometric or facial-recognition data. See “Face Data & Biometrics” below.

2. Face Data & Biometrics

Kafios does not collect, extract, generate, or store any biometric face data — no faceprints, face templates, facial geometry, or unique facial identifiers. The app performs no face detection, face recognition, or facial mapping.

The only data involved is a standard photograph that you voluntarily select from your photo library or capture with the camera. That photo may contain a person's face, but it is treated purely as a regular image file — it is never analyzed to derive biometric or identity information.

Your photo is used only when you explicitly tap “Generate” to create an edited image. It is never used for identification, authentication, matching, tracking, advertising, profiling, or building any facial database.

3. How We Use Information

We use information to:

• Generate the edited image you request
• Provide and improve our services
• Maintain app functionality and security
• Analyze usage and performance
• Manage subscriptions and customer support

4. AI Processing & Third-Party Sharing

When you generate an image, the photo you select (which may include your face) and your text prompt are sent to Replicate, Inc., which runs the OpenAI gpt-image-2 model, solely to produce the image you request. Kafios does not collect, store, or generate any biometric face data, faceprints, or facial recognition data, and does not use your photo to identify you. Our servers (hosted on DigitalOcean) do not store your photo or your prompt; they are processed only to create your result. Generated images are stored only on your device and can be deleted by you at any time.

To generate the image, your selected photo and text prompt are transmitted to our AI image-processing provider, Replicate, Inc., which runs the OpenAI “gpt-image-2” image model to produce the result. These are the only third parties that receive the photo, and they receive it strictly to perform the image generation you requested.

Our backend is hosted on DigitalOcean and acts only as a pass-through: it does not store your photo or your text prompt. The generated result image is returned to you and stored only on your device.

We do not guarantee the accuracy, quality, suitability, legality, or reliability of AI-generated results.

5. Data Retention

We do not retain your photo at all. It is transmitted only for the duration of a single generation request and is never persisted on our DigitalOcean servers. We likewise do not retain your prompt text.

Our AI provider processes the image only to fulfill the request and does not retain it.

The generated output image is stored solely on your device for as long as you choose to keep it; deleting it in the app (or clearing history) removes it.

The only data persisted on our servers is non-image account and usage metadata: a per-install identifier, your credit balance, and an audit record of each generation (quality tier, aspect ratio, success/failure status, credits used, and timestamp).

6. Third-Party Service Providers

Kafios relies on third-party providers to deliver certain features and services. These providers may process data submitted through the app.

These providers include:

• Replicate, Inc. and OpenAI — AI image generation
• DigitalOcean — cloud hosting and infrastructure
• Apple — App Store payments and subscriptions
• Analytics and diagnostics providers

We are not responsible for the privacy practices, security measures, availability, content, actions, or omissions of third-party providers.

7. Purchases and Subscriptions

Payments and subscriptions are processed by Apple through the App Store.

We do not collect or store your payment card information.

Subscription management, billing, and refunds are subject to Apple's policies and terms.

8. Disclaimer of Liability

Kafios is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law:

• We make no warranties of any kind.
• We do not guarantee uninterrupted or error-free operation.
• We do not guarantee the accuracy, quality, or availability of generated content.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the app.
• We are not responsible for content generated, modified, uploaded, or shared by users.

Users are solely responsible for their use of the service and any content they create, upload, distribute, or rely upon.

9. User Responsibility

You agree not to upload content that:

• Violates applicable laws
• Infringes intellectual property rights
• Violates privacy rights
• Contains harmful, abusive, or illegal material

You are solely responsible for ensuring that you have all necessary rights and permissions for content submitted to the service.

10. Children's Privacy

Kafios is not intended for children under 13 years of age.

11. Changes to This Policy

We may update this Privacy Policy at any time without prior notice. Continued use of the app after changes constitutes acceptance of the updated policy.
